Margaritaville eGift Card

Margaritaville® Gift Card Terms and Conditions (the “Agreement” or “Terms and Conditions”) is proprietary to Margaritaville Gift Card, LLC (“Margaritaville”) for the Margaritaville Gift Card program unless otherwise indicated. These Terms and Conditions are a binding agreement between you, the Gift Card holder (from now on referred to as the “Customer” accordingly) and Margaritaville. The Customer acknowledges having read this Agreement and agrees to be bound by its terms and conditions.

  1. Margaritaville Gift Cards can be purchased online at Margaritaville.com/gift-cards or any Margaritaville participating branded location.

  2. Purchasers can purchase Margaritaville Gift Cards by credit card and cash with card values from $25 up to $500 USD to a maximum transaction value of $2,000 per day.

  3. The value of the Margaritaville Gift Card shall only be redeemed to purchase products and services (the “Services”) from participating Margaritaville branded locations ( see participating locations at Margaritaville.com/gift-cards), each one from now on referred to as “Margaritaville” locations. The Margaritaville gift card cannot be used for telephone orders, gambling transactions, or event tickets. The Margaritaville Gift Card may not be used for deposit, advance purchase, or to secure or confirm a reservation.

  4. Margaritaville Gift Cards shall have the same value as it was purchased for. To avoid doubt, if a $100 USD gift card was purchased for $100 USD, then the card shall be redeemed as cash worth $100 USD to buy Services from participating Margaritaville locations.

  5. All Gift Card sales are final and are not refundable or redeemable for cash or check once the purchase has been completed, except to the extent required by law.

  6. Margaritaville Gift Cards will be activated only following the completion of full payment. Payment is considered complete once the payment processing method and fraud prevention procedures are finalized, and a receipt is issued to the Client to confirm the purchase.

  7. No fee shall be charged for the activation of the Margaritaville Gift Card.

  8. No fee shall be charged for the use of a Margaritaville Gift Card.

  9. Margaritaville Gift Cards have value once they are activated.

  10. Digital Margaritaville Gift Cards are delivered immediately after completion and acceptance of the purchase by secure email or mail at the address provided to Margaritaville by the purchaser and can be redeemed directly upon activation.

  11. Margaritaville Gift Cards cannot be resold. Unlawful resale or attempted resale is grounds for cancellation of the Gift Card without compensation.

  12. Margaritaville reserves the right to deactivate or reject any Margaritaville Gift Card issued or procured, directly or indirectly, in connection with fraudulent actions.

  13. Margaritaville reserves the right to suspend, refuse, hold for review or cancel any Margaritaville Gift Card order for which fraud is suspected, for Margaritaville Gift Cards mistakenly issued in an incorrect denomination, or for any other violation of these Terms and Conditions.

  14. To check the remaining balance of a Margaritaville Gift Card, the Client may visit Margaritaville.com/gift-cards.

  15. Margaritaville Gift Cards purchased and/or activated after this TBD are reloadable. Margaritaville Gift Cards purchased and/or activated before are not reloadable.

  16. Margaritaville Gift Cards do not expire.

  17. Margaritaville promotional certificates issued for promotional purposes may contain an expiration date.

  18. While resale or attempted resale for compensation is prohibited (see section 11 above), Margaritaville Gift Cards are otherwise fully transferable when given for free to friends, family, or others as gifts, and, if they are transferred, the new Gift Card holder shall be bound by these Terms and Conditions.

  19. Margaritaville Gift Cards must be presented in person at participating locations or used at the time of payment and cannot be retroactively applied once payment is complete. Photos or photocopies of physical gift cards will not be accepted. Cards cannot be used for online transactions.

  20. Margaritaville Gift Cards can be redeemed only at participating Margaritaville locations as listed at Margaritaville.com/gift-cards.

  21. If the price of the Services is less than the value of the Gift Card, the remaining value of the Gift Card is retained until the stored value reaches a zero balance.

  22. If the cost of the Services being purchased is greater than the value of the Gift Card, the stored value will be depleted to zero value, and the difference must be paid with another Gift Card or other accepted form of payment such as cash or credit card.

  23. Margaritaville Gift Cards will not be accepted if the number is invalid, has not been activated, has been deactivated, is declined, or cannot be found within the system.

  24. Margaritaville Gift Cards will not be accepted if the Gift Card number has been damaged and is illegible, missing, or incorrect.

  25. Once a Margaritaville Gift Card is deactivated, it cannot be reactivated.

  26. If the Services purchased (in part or in full) using a Margaritaville Gift Card is being refunded, the value or the unused portion thereof (based on the terms and conditions of the Services being refunded) that was initially paid for by using a Margaritaville Gift Card will be refunded to a Margaritaville Gift Card.

  27. Margaritaville is not responsible for any stored value balance if the Margaritaville Gift Card is lost, stolen, damaged or destroyed. The value will not be refunded if lost, stolen, damaged, destroyed, or used without authorization. Ownership and risk of loss is transferred to the recipient of the Gift Card immediately upon completion of processing of the order. Treat gift cards like cash.

  28. Margaritaville Gift Cards are not credit or debit cards with no implied warranties.

  29. Margaritaville is not responsible should technical problems arise, and the Margaritaville Gift Card is not redeemable temporarily. Client agrees, in such an event, to return later to redeem its Margaritaville Gift Card once the technical problem is resolved.

  30. The Client agrees that these Terms and Conditions shall be governed by, construed and/or interpreted in accordance with the laws of Florida and the laws of The United States of America applicable therein and shall be treated in all respects as a Florida contract, without regard to the principles of conflict of law that would impose a law of another jurisdiction.

  31. Any dispute relating to a Margaritaville Gift Card shall be adjudicated in the State of Florida, and the Client agrees to the exclusive jurisdiction of the Florida Court and venue of such courts.

  32. Margaritaville may offer Margaritaville promo cards as part of a marketing promotion and may contain an expiration date. If you receive a Margaritaville promo card, it will be identified as a promo card and not a gift card. The expiry date will be shown on the card.

  33. Businesses registered in The United States with an approved Margaritaville account can purchase Margaritaville Gift Cards by credit card or Electronic Funds Transfer (EFT/ACH), with card values from $25 up to $500 USD to a maximum transaction value of $2000 USD per day.

  34. All Corporate orders must be paid in full before Margaritaville Gift Cards are delivered physically or electronically.
